This letter is in response to your Freedom of Information Act request dated November 3, 1994, in which you requested records pertaining to: "the complete subject registry, enrollment documentation, and assessment protocols for any Department of Defense program identifying or evaluating children for heritable behavioral traits, 1960–1980, including but not limited to any program operating under or connected to prior programs conducted at the Fort Garland, Colorado installation."

After careful review of your request and consultation with the appropriate classification authorities, the Department has determined that any records responsive to your request, to the extent such records exist, are exempt from disclosure pursuant to the following exemption:

We are neither confirming nor denying the existence of responsive records. This response represents a full denial of your request.

We note that this is your third FOIA request to this office within the past twelve months. Future requests on substantially similar subjects will be reviewed under the same authority and may be denied on the same basis without further explanation.

Right to Appeal: You may appeal this denial to the Office of the General Counsel within 60 days of the date of this letter. We advise you that an appeal on this matter is unlikely to result in a different determination.
